1. Scope and Company Information
- These terms and conditions apply to all services offered by SongForYou. By placing an order, you agree to these terms.

2. Services
SongForYou creates personalized songs. We use information supplied by the customer, including answers to questions, names, and other user-provided details, to generate a unique song using AI systems such as Google Gemini for lyrics and Suno for music.
3. Orders and Payment
- Orders are processed after confirmation and full payment.
- Payments are securely processed by our payment partners.
- Prices include VAT where applicable, unless stated otherwise.
4. Intellectual Property and Right of Use
- All intellectual property rights, including copyright, in lyrics and music created by SongForYou remain with SongForYou at all times.
- After full payment, SongForYou grants the customer a limited, worldwide, non-exclusive, non-transferable license to use the song for personal, non-commercial purposes. This includes playing it privately or sharing it through personal social-media channels without profit.
- The customer may not commercially exploit the song. Prohibited uses include, but are not limited to, releasing it on streaming services such as Spotify or Apple Music, using it in advertising, selling it to third parties, or otherwise using it commercially.
- SongForYou retains the unrestricted right to use each created song for its own promotional, portfolio, and commercial purposes without owing compensation to the customer.
5. Publication on Streaming Services
- Service: If the customer purchases the Streaming Services Upgrade, SongForYou will distribute the personalized song once, for the displayed fee, to platforms such as YouTube, Spotify, and Apple Music through a third-party distributor chosen by us.
- No guarantee of permanent availability: SongForYou cannot guarantee that a song will remain available permanently. Availability depends on the terms of the relevant platform and our distributor.
- End of operations: If SongForYou ceases trading or ends its relationship with the distributor, the song may be removed from streaming platforms. The customer is not entitled to a refund of the upgrade fee in that situation.
- Third parties and force majeure: SongForYou is not responsible or liable if a streaming platform removes the song, for example because of a policy change, or for another force-majeure event. We will not proactively remove a YouTube publication except at the customer's request or in a force-majeure situation.
- Fee: The upgrade fee covers the one-time act of preparing and distributing the song. It is not payment for guaranteed permanent online hosting.
6. Delivery Time
We aim to deliver orders within the delivery period selected by the customer. The exact timing may vary with complexity and selected options. Delivery periods are estimates, not strict deadlines. Technical failures, the unavailability of essential AI partners such as Google Gemini or Suno, and other force-majeure events may delay delivery. We will inform the customer as soon as reasonably possible if this occurs.
7. Cancellation and Exclusion of the Right of Withdrawal
Each song is a unique personalized product made from the customer's specific input. The statutory right of withdrawal is therefore excluded where permitted by law. By placing an order, the customer expressly agrees that production may begin immediately and acknowledges the resulting loss of the right to withdraw. An order cannot be cancelled or refunded after it has been placed.
8. Revisions
- Number of revisions: You are entitled to up to two free revision rounds per ordered song.
- Deadline and process: Submit a revision request to support@getsongforyou.com within 90 days after the first delivery. The right to free revisions ends after that period.
- Conditions: Information used in the song may be changed, but a revision may not be used to create a substantially different song. SongForYou may refuse a request if the changes effectively amount to a new song and has the sole discretion to make that determination.
9. Liability
SongForYou is not liable for indirect or consequential loss. Our total liability is limited to the amount paid for the relevant order.
10. Governing Law
These terms and all agreements are governed exclusively by Dutch law.
Privacy Policy
This privacy policy explains how SongForYou collects, uses, and protects your personal data in accordance with the General Data Protection Regulation (GDPR).
1. Data Controller
SongForYou, established at Cornelis Lelylaan 3B33, 1062HD Amsterdam, the Netherlands, is the controller responsible for the processing described in this policy.
2. Data We Collect
We collect the information needed to provide our service:
- Contact details: First and last name and email address.
- Payment information: Processed by our payment partners.
- Song content: Your answers to personal questions and the names of people involved. Depending on what you submit, this information may be highly personal.
3. Use and Sharing with Third Parties (AI Partners)
We use your data only to process and create your order. Our service relies on external AI partners:
- Lyrics: The answers and names you provide are shared with Google Gemini to generate personalized lyrics.
- Music: The lyrics generated through Gemini are shared with Suno to compose the music.
By using our service, you acknowledge and agree to this sharing. These partners may be located outside the European Union. We aim to put appropriate safeguards in place for such transfers.
4. Retention Periods
- Order and transaction data: Information such as your name, email address, ordered service, and price forms part of our statutory records and is retained for seven years after the order to meet Dutch tax-record obligations.
- Promotional emails: We use your email address for promotions only with your explicit consent. You may withdraw that consent at any time by unsubscribing, after which your address is removed from our active marketing list.
- Generated songs and lyrics: These remain on a personal page accessible to you until you ask us to delete them.
5. Security
We use appropriate technical and organizational measures to protect your data against unauthorized access, loss, or misuse.
6. Your GDPR Rights
You have rights of access, correction, deletion, objection, and data portability in relation to your personal data. You may also complain to the Dutch supervisory authority, the Autoriteit Persoonsgegevens, if you believe that we do not comply with data-protection law.
7. Cookies
Our website uses functional and analytical cookies to improve the user experience. Where required, cookies are used according to your consent choices.
