1. Applicability and Company Information
- These general terms and conditions apply to all services offered by SongForYou. By placing an order, you agree to these terms.

2. Service Description
SongForYou creates personalized songs. We use the information provided by the customer (answers to questions, names, other user-provided information) to generate a unique, custom-made song using advanced AI systems (such as Google's Gemini for lyrics and Suno for music).
3. Orders and Payment
- All orders are processed after confirmation and full payment.
- Payments are securely processed through our payment partners.
- Prices are inclusive of applicable taxes unless otherwise stated.
4. Intellectual Property and Usage Rights
- All intellectual property rights, including copyright, on the lyrics and music pieces created by SongForYou, are and remain at all times with SongForYou.
- After full payment, SongForYou grants the customer a limited, worldwide, non-exclusive, non-transferable license to use the song for personal, non-commercial purposes. This includes, for example, playing it at home or sharing it via personal social media channels without commercial intent.
- The customer is expressly not permitted to commercially exploit the song. This includes, but is not limited to, releasing it on streaming services (such as Spotify, Apple Music), use in advertisements, sale to third parties, or any other use with a commercial purpose.
- SongForYou reserves the unlimited right to use any created song for its own promotional, portfolio and commercial purposes, without any compensation being owed to the customer.
5. Publication on Streaming Services
- Service description: If the customer chooses the 'Streaming Services Upgrade', SongForYou will distribute the personalized song, for the stated fee, once to streaming platforms such as YouTube, Spotify and Apple Music via an external distributor of our choice.
- No Guarantee of Permanent Availability: SongForYou cannot guarantee that the song will remain permanently available on platforms like Spotify. Availability depends on the terms of both the streaming platform and our distributor.
- Termination of Activities: In the event that SongForYou ceases its business activities, or terminates its collaboration with its distributor, the song will likely be removed from streaming platforms. The customer is not entitled to a refund of the upgrade fee in this case.
- Role of Third Parties and Force Majeure: SongForYou is not responsible or liable for the removal of the song by the streaming platforms themselves (for example, due to a policy change) or for other forms of force majeure. For YouTube, SongForYou will not proactively remove the song unless at the customer's request or in case of force majeure.
- Fee: The fee for the upgrade covers the one-time action of preparing and distributing the song. It is not a payment for guaranteed permanent online hosting.
6. Delivery Time
We aim to deliver all orders within the delivery time chosen by the customer, ranging from 2 to 7 days. Exact delivery times may vary depending on the complexity and chosen options. Stated delivery times are target times and not strict deadlines. In case of force majeure, which explicitly includes technical failures or unavailability of our crucial AI partners (such as Google Gemini and Suno), the delivery time may be extended. We will inform the customer as soon as possible in such a case.
7. Cancellation and Exclusion of Right of Withdrawal
Because each song is a unique and personalized product manufactured based on the specific input of the customer, the legal right of withdrawal is excluded. By placing an order, the customer expressly agrees that production begins immediately and that they thereby waive the right of cancellation. Cancellation and refund after placing an order is therefore not possible.
8. Right to Revision
- Number of revisions: You are entitled to a maximum of two (2) free revision rounds per ordered song.
- Revision period and procedure: A revision request must be submitted within 90 days after the first delivery via support@songforyou.com. After this period expires, the right to free revisions lapses.
- Conditions: All information included in the song may be adjusted. However, it is not permitted to use the revision to create a substantially different song. SongForYou reserves the right to refuse a revision request if the changes are so extensive that it constitutes a new song. SongForYou holds the sole right to judge this.
9. Liability
SongForYou is not liable for indirect damage or consequential damage. Our liability is at all times limited to the amount of the relevant order.
10. Applicable Law
These terms and all agreements are exclusively governed by the laws of the jurisdiction in which SongForYou operates.
Privacy Policy
This privacy policy describes how SongForYou collects, uses and protects your personal data, in accordance with applicable data protection regulations including the General Data Protection Regulation (GDPR).
1. Data Controller
SongForYou is the data controller for the processing of personal data as described in this privacy policy.
2. Data We Collect
We collect the data necessary for our service delivery:
- Contact details: First and last name, email address.
- Payment information: Processed through our payment partners.
- Content for the song: The answers you fill in to personal questions and the names of the people involved. This data may, depending on what you fill in, be of a very personal nature.
3. Use and Sharing of Data with Third Parties (AI Partners)
Your data is used exclusively for processing and creating your order. To provide our service, we use external AI partners.
- For the lyrics: The answers and names you provide are shared with Google's AI services (Gemini) to generate the personalized lyrics.
- For the music: The lyrics generated by Gemini are then shared with Suno's AI services to compose the music.
By using our service, you acknowledge and agree that this data will be shared with these partners. These partners may be located outside the European Union. We strive to take appropriate safeguards for this transfer.
4. Retention Periods
- Order and transaction data (including name, email, ordered service and price): This data is part of our legal administration. Due to tax retention requirements, we are required to keep this data for 7 years after your order.
- Promotional emails: We only use your email address for promotional purposes if you give explicit consent. You can withdraw this consent at any time by unsubscribing. Your email address will then be removed from our active marketing list.
- Generated songs and lyrics: These are stored on a personal page accessible to you. This content remains stored until you request us to delete it.
5. Security
We take appropriate technical and organizational measures to protect your data against unauthorized access, loss or misuse.
6. Your Rights
You have the right to access, correct, delete, object and data portability of your personal data. You also have the right to file a complaint with the relevant data protection authority if you believe we are not complying with privacy legislation.
7. Cookies
Our website uses functional and analytical cookies to improve the user experience. By using our website, you agree to the use thereof.
